NOTICE OF PUBLIC SALE BY MEANS OF NON- JUDICIAL FORECLOSURE_ he
Richwoods Association ofHomeowners, Inc. (" Association").
WHEREAS, that certain Declaration of Covenants, Conditions and Restrictions recorded as
Document No. 20120409000405490, as amended and supplemented from time to time ( the
Declaration"), grants to the Association the power ofsale as per the Declaration and The Texas
Property Code.
WHEREAS, Yan Suis the owner ofthebelow described property that is subject to the Declaration
and has failed to pay assessments to the Association after due notice; and
WHEREAS, the Association has appointed Daniel E. Pellar as Substitute Trustee to conduct the
foreclosure sale in accordance withthe Declaration and Chapter 51 ofthe Texas Property Code;
NOW THEREFORE THE FOLLOWING NOTICE OF THE SALE IS GIVEN:
1. Property to be Sold. Lot 18, Block 60, of Richwoods Phase Twenty1Four, an addition
to the City of Frisco, Collin County, Texas, according to the Plat thereof recorded in
Volume 2016, Page 61 of the Deed Records of Collin County, Texas [ 13206 Dolomite
Drive, Frisco, Texas 75035] ( the " Property"). The conveyance of the Property will
be as is and subject to any valid superior first mortgage lien or deed oftrust, tax
lien, or other superior lien interest secured by the Property.
2. Date, Time, and Place of Sale. The sale is scheduled to be held at the following date,
time, and place:
Date: October 6, 2026
Time: Between 10:00 a.m. and 1: 00 p.m. local time
Location: The Southwest Entrance of the Jack Hatchell Collin County Administration
Building located at 2300 Bloomdale Road, McKinney, Texas 75071 or as otherwise
designated by Collin County attime ofsale.
Ifthe Association elects to postpone or withdraw orreschedule the nonjudicial foreclosure
sale for another day, the appointed agent under the Lien need not appear at the date, time,
and place ofthe scheduled sale to announce suchpostponement, withdraw, orrescheduling.
Notice of the date of any rescheduled foreclosure sale will be reposted and refilled inaccordance with the posting and filing requirements of the Texas Property Code. Such
reposting or refilling may be after the date originally scheduled for said foreclosure sale.
3. Terms ofSaleThe sale will be conducted as apublic auction to the highest bidder for cash.
Those desiring to purchase the property will need to demonstrate their ability to pay cash
on the day ofsale for the property being sold.
4. Type ofSale. The sale will be a nonjudicial lien foreclosure sale in accordance with the
terms and authority granted the Association by the Declaration and the attached Order
obtained in accordance with Tex. R. Civ. P. 736.
5. Obligation Secured. TheDeclaration secures thepaymentofthe Associationhomeowner
member assessments, and the Association' s fees and costs associated with collecting these
assessments.
6. Default and Request to Act. Default has occurred under the terms ofthe Declaration and
the Association has requested that the undersigned Authorized Agent to conduct the non-
judicial foreclosure sale. Notice is hereby given that prior to the foreclosure sale the
Association may appoint another person to act as anAppointed Agent to conduct said sale.

The Court, considering both the Richwoods Association of Homeowners, Inc.' s
Petitioner") Application forExpeditedForeclosure filedpursuanttoRule736 oftheTexas Rules
of Civil Procedure (the " Application") concerning 13206 Dolomite Drive, Frisco, Texas 75035
the" Property") and owned by Respondent, Yan Su, fmds as follows:
1. The Property is subject to an assessment obligation owed to the Petitioner and a lien
sought to be foreclose which is contained in the Declaration ofCovenants, Conditions
and Restrictions recorded as Document No. 20120409000405490 in the Real Property
Records of Collin County, Texas, as amended and/or supplemented ( hereinafter the
Declaration") and which requires the Respondent to pay the Petitioner certain property
owners' association assessments and related charges. The assessments, together with
interest, late fees, costs, and reasonable attorney's fees, are secured by a lien in favor
of the Petitioner against the Property ( Article XI, Section 11. 8). See Petitioner' s
Application, Exhibit" A-4";
PROPOSED ORDER 12. Respondent owns the property which is the subject ofthe Petitioner' s lien sought to be
foreclosed in the Application with the following legal description and street address as
evidencedbythevesting deedrecordedunderthe CollinCountyClerk's DocumentNo.
2023000070666 attached to Petitioner' s Application as Exhibit" A-3":
Lot 18, Block 60 ofRichwoods Phase Twenty-Four, An Addition to
the City ofFrisco, Collin County, Texas, according to the Plat
thereof recorded in Volume 2016, Page 61 ofthe Plat Records of
Collin County,Texas [ 13206 Dolomite Drive)(the "Property").
3. As reflected by the material evidence presented in the Application in the form of
affidavits and evidence provided at the final hearing, the Respondent has breached his
obligation and is delinquent in the payment ofthe assessments, late interest, collection
fees, violation fines, and legal fees, and which are secured by the Declaration lien
against the Property;
4. As reflected in Exhibit " A" and " B" to the Application, Petitioner has given the
Respondent the requisite notice to cure the default in accordance with applicable law
and the Declaration and the unpaid amount to cure the defaulted amount and reinstate
theRespondents as setforth intheApplication,was$ 4,041.25 and any further accrued
amounts now due.
5. Respondent' s last known address in the records of the Petitioner is 132-6 Dolomite
Drive, Frisco, Texas 75035( Exhibit" C" to the Application);
6. Respondent, on information and belief, is not a servicemember within the meaning of
the Servicemembers Civil Relief Act. See Exhibit" D" ofthe Petitioner' s Application.
A copy ofExhibit" D" is also attached to Petitioner's Application.
7. Petitioner filed its Application in accordance with the requirements ofRule 736 of the
Texas Rules ofCivil Procedure and sustained the burden ofproofrequired pursuant to
PROPOSED ORDER 2Tex. R. Civ. P. 736.6 through the form of affidavits and evidence presented in the
Application.
8. Respondent was properly served in accordance with Rule 736 Of the Texas Civil
Practice& Remedies Code and failed to file aresponse within the time period mandated
by Rule 736 and filed his Response andhas failedto provide any admissible evidence
and sustainhis/her affirmative burden or proofrequired by Tex. R. Civ. P. 736.5.
9. Accordingly, the Petitioner has met its burden ofproof as required by Rule 736 ofthe
Texas Civil Practice and Remedies Code and is entitled to an order permitting it to
pursue nonjudicial foreclosure notice and sale in accordance Texas law.
ORDERED that Petitioner, the Richwoods Association of Homeowners, Inc.' s Application for
Expedited Foreclosure Proceeding filed in accordance with Rule 736 ofthe Texas Rules ofCivil
Procedure, against the Property, 13206 Dolomite Drive, Frisco, Texas 75035 with the following
legal description:
Lot 18, Block 60 ofRichwoods Phase Twenty-Four, An Addition to the City ofFrisco,
Collin County, Texas, according to the Plat thereof recorded in Volume 2016, Page 61
ofthe Plat Records ofCollin County, Texas
is in all things GRANTED. It is further ORDERED that Petitioner is authorized to proceed with
notice of foreclosure sale and foreclosure of the Property through, and in accordance with,
Petitioner's lien under the Declaration and pursuant to Section 209.0092 ofthe Texas Property
Code.
