NOTICE OF SUBSTITUTE TRUSTEE’S SALE
1. Property to Be Sold. = The property to be sold is described as follows:
The real property and improvements located in Bexar County, Texas, commonly known as 403 San
Pedro Avenue, San Antonio, Texas 78212, being more particularly described on Schedule 1 attached
hereto and incorporated herein for all purposes.
2. Instrument to be Foreclosed. The instrument to be foreclosed is the Deed of Trust dated June 22, 2016,
recorded under Document No. 20160118685, Official Public Records of Bexar County, Texas (the
“Deed of Trust”).
3. Date, Time, and Place of Sale. The sale is scheduled to be held at the following date, time, and place:

Time: The sale will begin no earlier than 10:00 a a.m. or no later than three hours thereafter. The
sale will be completed by no later than 1:00 p.m.
Place: At the area designated by the County Commission of Bexar County, located outside on
the west side of the Bexar County Courthouse which is near the intersection of East
Nueva Street and the closed portion of South Main Avenue, San Antonio, Texas 78205.
The Deed of Trust permits the beneficiary to postpone, withdraw, or reschedule the sale for another day.
In that case, the trustee or substitute trustee under the Deed of Trust need not appear at the date, time, and place
of a scheduled sale to announce the postponement, withdrawal, or rescheduling. Notice of the date of any
rescheduled foreclosure sale will be reposted and refiled in accordance with the posting and filing requirements
of the Texas Property Code. The reposting or refilling may be after the date originally scheduled for this sale.
4, Terms of Sale. The sale will be conducted as a public auction to the highest bidder for cash, subject to
the provisions of the Deed of Trust permitting the beneficiary thereunder to have the bid credited to the
note up to the amount of the unpaid debt secured by the Deed of Trust at the time of sale.
Those desiring to purchase the Property will need to demonstrate their ability to pay their bid
immediately in cash if their bid is accepted.
The sale will be made expressly subject to any title matters set forth in the Deed of Trust, but
prospective bidders are reminded that by law the sale will necessarily be made subject to all prior matters of
record affecting the Property, if any, to the extent that they remain in force and effect and have not been
subordinated to the Deed of Trust. The sale shall not cover any part of the Property that has been released of
public record from the lien of the Deed of Trust. Prospective bidders are strongly urged to examine the
applicable property records to determine the nature and extent of such matters, if any.
Pursuant to the Deed of Trust, the beneficiary has the right to direct the trustee or any appointed
substitute trustee to sell the Property in one or more parcels and/or to sell all or only part of the Property.
Pursuant to section 51.009 of the Texas Property Code, the Property will be sold in “as is, where is”
condition, without express or implied warranties, except as to the warranties of title (if any) provided for under

the Deed of Trust. Prospective bidders are advised to conduct an independent investigation of the nature and
physical condition of the Property.
Pursuant to section 51.0075 of the Texas Property Code, the trustee or substitute trustee reserves the
right to set further reasonable conditions for conducting the sale. Any such further conditions shall be
announced before bidding is opened for the first sale of the day held by the trustee or any substitute trustee.
5. Type of Sale. The sale is a nonjudicial deed of trust lien and security interest foreclosure sale being
conducted pursuant to the power of sale granted by the Deed of Trust executed by 401 San Pedro LLC.
The real property and personal property encumbered by the Deed of Trust will be sold at the sale in
accordance with the provisions of the Deed of Trust and as permitted by section 9.604(a) of the Texas Business
and Commerce Code.
6. Obligations Secured. The Deed of Trust provides that it secures the payment of the indebtedness and
obligations therein described (collectively, the “Obligations”) including but not limited to (a) the Promissory
Note in the original principal amount of $982,464.00, executed by 401 San Pedro LLC. and payable to the order
of Frost Bank; and (b) all renewals and extensions of the note. Frost Bank is the current owner and holder of the
Obligations and is the beneficiary under the Deed of Trust.

7. Default and Request to Act. Default has occurred under the Deed of Trust, and the beneficiary has
requested the substitute trustee to conduct the sale. Notice is given that before the sale the beneficiary may
appoint another person substitute trustee to conduct the sale.
8. ASSERT AND PROTECT YOUR RIGHTS AS A MEMBER OF THE ARMED FORCES OF THE
UNITED STATES. IF YOU OR YOUR SPOUSE IS SERVING ON ACTIVE MILITARY DUTY,
INCLUDING ACTIVE MILITARY DUTY AS A MEMBER OF THE TEXAS NATIONAL GUARD OR THE
NATIONAL GUARD OF ANOTHER STATE OR AS A MEMBER OF A RESERVE COMPONENT OF THE
ARMED FORCES OF THE UNITED STATES, PLEASE SEND WRITTEN NOTICE OF THE ACTIVE
DUTY MILITARY SERVICE OT THE SENDER OF THIS NOTICE IMMEDIATELY.

BEING 0.378 acres of land, more or less, consisting of all of Lots 1 and 2, Block 7, New City Block
769, situated in the corporate limits of the City of San Antonio, Bexar County, Texas, SAVE AND
EXCEPT those portions of said Lots 1 and 2 conveyed to the City of San Antonio by Deed recorded in
Volume 5689, Page 543, and Volume 5757, Page 746, Deed Records, Bexar County, Texas, and being
that same property conveyed in Warranty Deed recorded in Volume 11092, Page 2248 and Volume
11092, Page 2250, Official Public Records, Bexar County, Texas, said 0.378 acres being more
particularly described by metes and bounds as follows:
BEGINNING at a 1 inch iron pipe found for the southwest corner of this 0.378 acres, same being the
southwest corner of said Lot 1 and at the intersection of the northwest Right-of-Way line of W. Euclid
Ave. and the northeast Right-of-Way line of Jackson same also being the POINT OF BEGINNING;
THENCE along the northwest Right-Of-Way line of said Jackson, North 33 degrees 33 minutes 00
seconds West (bearing basis), a distance of 113.44 feet (called 104.98 feet) to a % inch iron rod found
for the West corner of this 0.378 acres, same being the West corner of said Lot 2 and the southeast
corner of the Barbara Woodward, et vir 0.5788 acres (Volume 7790, Page 1359);
THENCE along the line common to this 0.378 acres and said Woodward 0.5788 acres, North 56
degrees 40 minutes 34 seconds East (called North 56 degrees 17 minutes 20 seconds East), a distance of
144.56 feet (called 144.46 feet) to a % inch iron rod found for the northeast corner of this 0.378 acres,
same being the East corner of said Woodward 0.5788 acres and on the southwest Right-of-Way line of
San Pedro Ave.;
THENCE along the southwest Right-of-Way line of said San Pedro Ave., South 34 degrees 06 minutes
30 seconds East, a distance of 113.76 feet to a point for the southeast corner of this 0.378 acres, same
being the intersection of the southwest Right-of-Way line of said San Pedro Ave. and the northwest
Right-of-Way line of said W. Euclid Ave.;
THENCE along the northwest Right-of-Way line of said W. Euclid Ave., South 56 degrees 48 minutes
02 seconds West, a distance of 145.69 feet to the POINT OF BEGINNING, and containing 0.378 acres
of land, more or less.
