NOTICE OF PUBLIC SALE BY MEANS OF NON-JUDICIAL FORECLOSURE by The
Homeowners Association of Lone Star Ranch, Inc. d/b/a Lone Star Ranch Homeowners
Association (“Association”)
WHEREAS, that certain Declaration of Covenants, Conditions and Restriction for Lone Star
Ranch Residential Properties filed in the Public Records of Denton County, Texas as Document
No. 061496, Volume 4865, Page 1290 et. seg., as amended from time to time (“Declaration”),
grants to the Association the power of sale as per the Declaration and The Texas Property Code.
WHEREAS, Oleg Shtereb is the owner of the below described property that is subject to the
Declaration and has failed to pay assessments to the Association after due notice and that attached
Final Order was obtained in Cause No. 25-11616-431 authorizing the Association to proceed with
notice and foreclosure sale; and
WHEREAS, the Association has appointed Daniel E. Pellar as Substitute Trustee to conduct the
foreclosure sale in accordance with the Declaration and Chapter 51 of the Texas Property Code;
NOW THEREFORE THE FOLLOWING NOTICE OF THE SALE IS GIVEN:
1. Property to be Sold. Lot 17, Block C of Lakeside at Lone Star Ranch, An Addition to the City of
Frisco, Denton County, Texas, according to the Plat thereof recorded in Cabinet V, Page 562 of the
Plat Records of Denton County, Texas, 4631 Fallmeadow Drive, Frisco, Texas 75034, (together
with all improvements, fixtures, and appurtenances thereto (“Property”). The conveyance of.
the Property will be subject to any valid first lien mortgage or Deed of Trust, tax liens or other
superior liens secured by the Property.
2. Date, Time, and Place of Sale. The sale is scheduled to be held at the following date,
time, and place:
Date: June 2, 2026
Time: Between 10:00 a.m. and 1:00 p.m. local time
Location: Courtyard of southwest corner of the Denton County Court Building, 1450
East McKinney Street, Denton, Denton County Texas 76209.
If the Association elects to postpone or withdraw or reschedule the non-judicial foreclosure
sale for another day, the appointed agent under the Lien need not appear at the date, time,

and place of the scheduled sale to announce such postponement, withdrawl, or
rescheduling. Notice of the date of any rescheduled foreclosure sale will be reposted and
refilled in accordance with the posting and filing requirements of the Texas Property Code.
Such reposting or refilling may be after the date originally scheduled for said foreclosure
sale.
. Terms of Sale The sale will be conducted as a public auction to the highest bidder for cash.
Those desiring to purchase the property will need to demonstrate their ability to pay cash
on the day of sale for the property being sold.
. Type of Sale. The sale will be a non-judicial lien foreclosure sale in accordance with the
terms and authority granted the Association by the Declaration of Covenants, Conditions,
and Restrictions filed in the Public Records of Denton County, Texas as Document No.
061496, Volume 4865, Page 1290 et. seg., and the attached Order obtained in accordance
with Tex. R. Civ. P. 736.
. Obligation Secured. The Declaration secures the payment of the Association homeowner
member assessments, as well as costs and expenses associated with collection of the
assessments. ,
. Default and Request to Act. Default has occurred under the terms of the Declaration and
the Association has requested that the undersigned Authorized Agent to conduct the non-
judicial foreclosure sale. Notice is hereby given that prior to the foreclosure sale the
Association may appoint another person to act as an Appointed Agent to conduct said sale.

OF FORECLOSURE SALE AND FORECLOSURE SALE
The Court, considering both the Homeowners Association of Lone Star Ranch, Inc. d/b/a
Lone Star Ranch Homeowners Association’s (“Petitioner”), Application for Expedited
Foreclosure filed pursuant to Rule 736 of the Texas Rules of Civil Procedure (the “Application”),
and Oleg Shetereb’s (“Respondent”) Response, concerning 4631 Fallmeadow Drive, Frisco, Texas
75036 (the “Property”) and owned by Respondent, Oleg Sheterb, finds as follows:
1. The Property is subject to an assessment obligation owed to the Petitioner and a lien
sought to be foreclose which is contained in the Declaration of Covenants, Conditions
and Restrictions recorded at Volume 4865, Page 1290 et. seq., of the Real Property
Records of Denton County, Texas, as amended and/or supplemented (hereinafter the
“Declaration”) and which requires the Respondent to pay the Petitioner certain property
owners’ association assessments and related charges. The assessments, together with
interest, late fees, costs, and reasonable attorney’s fees, are secured by a lien in favor
of the Petitioner against the Property (Article XI, Section 11.8). See Petitioner’s
Application, Exhibit “A-4”;

Respondent owns the property which is the subject of the Petitioner’s lien sought to be
foreclosed in the Application with the following legal description and street address as
evidenced by the vesting deed recorded under the Denton County Clerk’s Document
No. 109031 attached to Petitioner’s Application as Exhibit “A-3”:
Lot 17, Block C of Lakeside at Lone Star Ranch, An Addition to the
City of Frisco, Denton County, Texas, according to the Plat thereof
recorded in Cabinet V, Page 562 of the Plat Records of Denton
County, Texas (the “Property”).
As reflected by the material evidence presented in the Application in the form of
affidavits and evidence provided at the final hearing, the Respondent has breached his
obligation and is delinquent in the payment of the assessments, late interest, collection
fees, violation fines, and legal fees, and which are secured by the Declaration lien
against the Property;
As reflected in Exhibit “A” and “B” to the Application, Petitioner has given the
Respondent the requisite notice to cure the default in accordance with applicable law
and the Declaration and the unpaid amount to cure the defaulted amount and reinstate
the Respondents as set forth in the Application, was $5,815.98 and any further accrued
amounts now due.
Respondent’s last known address in the records of the Petitioner is 4631 Fallmeadow
Drive, Frisco, Texas 75036 (Exhibit “C” to the Application);
Respondent, on information and belief, is not a servicemember within the meaning of
the Servicemembers Civil Relief Act. See Exhibit “D” of the Petitioner’s Application.
A copy of Exhibit «py is also attached to Petitioner’s Application.
Petitioner filed its Application in accordance with the requirements of Rule 736 of the
Texas Rules of Civil Procedure and sustained the burden of proof required pursuant to
Tex. R. Civ. P. 736.6 through the form of affidavits and evidence presented in the
Application.
8. Respondent was properly served in accordance with Rule 736 of the Texas Civil
Practice & Remedies Code and failed to file a response within the time period mandated
by Rule 736 and filed his Response, however, at the final hearing, Respondent failed
to provide any admissible evidence and sustain his affirmative burden or proof required
by Tex. R. Civ. P. 736.5.
9. Accordingly, the Petitioner has met its burden of proof as required by Rule 736 of the
Texas Civil Practice and Remedies Code and is entitled to an order permitting it to
pursue non-judicial foreclosure notice and sale in accordance Texas law.
ORDERED that Petitioner, the Homeowners Association of Lone Star Ranch, Inc. d/b/a Lone Star
Ranch Homeowners Association’s Application for Expedited Foreclosure Proceeding filed in
accordance with Rule 736 of the Texas Rules of Civil Procedure, against the Property, 4631
Fallmeadow Drive, Frisco, Texas 75036 with the following legal description:
Lot 17, Block C of Lakeside at Lone Star Ranch, An Addition to the City of Frisco,
Denton County, Texas, according to the Plat thereof recorded in Cabinet V, Page 562
of the Plat Records of Denton County, Texas.
is in all things GRANTED. It is further ORDERED that Petitioner is authorized to proceed with
notice of foreclosure sale and foreclosure of the Property through, and in accordance with,
Petitioner’s lien under the Declaration and pursuant to Section 209.0092 of the Texas Property
~ Code.
