WHEREAS, the property herein described is subject to the Declaration of Covenants,
Conditions and Restrictions for Heatherwood, filed of record on October 27, 2005, as Document
No. 2005- 0152066, of the Official Public Records of Collin County, Texas, ( including any
amendments thereof or supplements thereto is hereinafter referred to, collectively, as the
Declaration"). The Declaration provides for the payment ofassessments secured by alien on the
Lot ofthe non-paying owner.
WHEREAS, Heatherwood (McKinney) Homeowners Association, Inc. on February 6,
2025, April 29, 2025, and November 18, 2025, sent notice ofdefault in payment ofassessments to
MARCUS R. BROWNE, a Single Man, and KIDANIARIVERA, a SingleWoman, beingthe
reputed owners or current owners ofsaid real property; and
WHEREAS, the said MARCUS R.BROWNE, a Single Man, and KIDANIA RIVERA,
a Single Woman, have continued to default in the payment oftheir indebtedness to Heatherwood
McKinney) Homeowners Association, Inc. and the same is now wholly due, and Heatherwood
McKinney) Homeowners Association, Inc., acting by and through its duly authorized agent,
intends to sell the herein described property to satisfy the present indebtedness ofsaid owners to
Heatherwood (McKinney) Homeowners Association, Inc.
NOW, THEREFORE, notice is hereby given that on Tuesday, the 7th day ofJuly, 2026,
between 10:00 a.m. and 4:00 p.m., Heatherwood (McKinney) HomeownersAssociation, Inc. will
sell the herein described real estate ( including any improvements thereon) at public auction at the
front steps ofthe Collin County Courthouse located at 2100 Bloomdale Road, McKinney, Collin
County, Texas, or as designated by the Collin County Commissioners for such sales, to the highest
bidder for cash, subject to all unpaid advalorem taxes, superior liens and encumbrances ofrecord,
and a statutory right ofredemption. The earliest time at which said sale will begin will be 11: 00
a.m., andthe sale will take place not laterthan three (3) hours thereafter.
Said real estate is particularly described on Exhibit A attached hereto which is incorporated
hereinby reference for all purposes.
