NOTICE OF ASSESSMENT LIEN FORECLOSURE SALE
Notice is hereby given that a public sale at auction of the Property (as that term is defined and described below) will
be held at the date, time and place specified in this Notice.
DATE & TIME OF SALE: Tuesday, July 7, 2026 (which is the first Tuesday of that month). The earliest time at
which the sale shall occur is 1:00 p.m. The sale shall begin at that time or not later than three (3) hours after that
time. The Association will sell said real estate to the highest bidder for cash, subject to all superior liens and
encumbrances of record.
PLACE OF SALE: Rockwall County, Texas at the following location: the area immediately outside on the front
steps of the Rockwall County Courthouse, located at 1111 Yellowjacket Lane, in Rockwall, Rockwall County,
Texas, or as designated by the County Commissioner's Office or as designated by the County Commissioners
INFORMATION REGARDING THE LIEN AND POWER OF SALE THAT IS THE SUBJECT OF THIS SALE:
On or about October 9, 2025, a Notice of Unpaid Assessments Secured by Lien was filed in the Official Public
Records of Rockwall County, Texas as Document No. 20250000018541, covering the real property herein described
concerning default in the payment of indebtedness owing by JAMES ELY, the present owner of said real property, to
RWC Hillcrest Shores Three Homeowners Association, Inc.
SUBJECT PROPERTY DESCRIPTION: Lot 15, Block A, of Hillcrest Shores Phase Three, an addition to the City
of Rockwall, Rockwall County, Texas, according to the Map thereof recorded in Cabinet F, Slide 36, of the Plat
Records, of Rockwall County, Texas; together with all buildings, fixtures and other real property improvements
located on said real property; and the benefits and appurtenances on or appertaining to said real property and
improvements, with a common street address of 1670 Park View Dr., Rockwall, TX 75087 (hereinafter the
Property”).
POWER OF SALE: As per Chapters 51 and 209 of the Texas Property Code and Declaration of Covenants,
Conditions and Restrictions for Hillcrest Shores Estates Phase 3 dated March 4, 2004, filed March 11, 2004, as
Instrument No. 20040000300055, Book 3432, Volume 282, in the Official Public Records of Rockwall County,
together with each and every amendment and supplement thereto (the "Declaration").
OBLIGOR: JAMES ELY
OBLIGEE: RWC Hillcrest Shores Three Homeowners Association, Inc.
Therefore, at the date, time and place set forth above, the undersigned Trustee will sell the Property to the highest
bidder for cash.

NOTICE OF FORECLOSURE SALE AND FORECLOSURE SALE
ON THIS DATE, the Court considered RWC HILLCREST SHORES THREE
HOMEOWNERS ASSOCIATION, INC.'s Motion for Entry of Default Order Under TRCP 736.7 of the
Texas Rules of Civil Procedure relative to JAMES ELY (the "Respondent") and that certain real property
more particularly described as follows:
Lot 15, Block A, of Hillcrest Shores Phase Three, an addition to the City of Rockwall, Rockwall
County, Texas, according to the Map thereof recorded in Cabinet F, Slide 36, of the Plat Records,
of Rockwall County, Texas; together with all buildings, fixtures and other real property
improvements located on said real property; and the benefits and appurtenances on or appertaining
to said real property and improvements, with a common street address of 1670 PARK VIEW
DRIVE, Rockwall, TX 75087 (hereinafter the "Property”).
WHEREAS, a debt exists and is secured by a lien created under the by the Declaration of
Covenants, Conditions and Restrictions for Hillcrest Shores Estates Phase 3, dated March 4, 2004,
filed March 11, 2004, as Instrument No. 20040000300055, Book 3432, Volume 282, in the Official
Public Records of Rockwall County, Texas, (hereinafter, together with each and every amendment
and supplement thereto) (the “Declaration"), A default under the Declaration exists; Petitioner has
given Respondent the requisite notices to cure the default under the Section 209.0064 of the Texas
Property Code and applicable law.

Respondent’s last known address is 1670 PARK VIEW DRIVE, Rockwall, Texas 75087,
within Rockwall County, Texas. Petitioner has given Respondent the requisite notice of this proceeding
under Rule 736 of the Texas Rules of Civil Procedure.
Respondent, although duly served pursuant to citation issued by the clerk of the court, has failed
to file a response.
IT IS HEREBY:
ORDERED that Petitioner, RWC HILLCREST SHORES THREE HOMEOWNERS
ASSOCIATION, INC., is authorized to proceed with foreclosure of the Petitioner's lien under the
Declaration pursuant to Section 209,0092 of the Texas Property Code. It is further
ORDERED that Petitioner, RWC HILLCREST SHORES THREE HOMEOWNERS
ASSOCIATION, INC., may communicate with the Respondent and all third parties reasonably
necessary to conduct the foreclosure sale of the property, and, if Respondent is represented by legal
counsel, notice of the foreclosure sale date shall also be mailed to legal counsel by certified mail.
