NOTICE OF PUBLIC SALEBY MEANS OF NON-JUDICIAL FORECLOSUREby the
Lakeside
on Preston Master Association, Inc. (" Association").
WHEREAS, thatCorrectedFirstAmended and Restated Master Declaration ofCovenants, Conditions and
Restrictions for Lakeside on Preston, filed of recorded as Document No. 2004-0083401 etseq., in the Real
Property Records of Collin County, Texas, as amended and/ or supplemented ( hereinafter the
Declaration"), and the Texas Property Code grant to theAssociation alien and the power ofsale.
WHEREAS, Harold G. Hughes and Robin M. Hughes, the owners ofthe below described property that is
subject to the Declaration and has failed,to pay assessments to the Association after due notice; and
WHEREAS, the Association has appointed Daniel E. Pellar as Substitute Trustee to conduct the foreclosure
sale in accordance withtheDeclaration and Chapter 51 ofthe Texas Property Code;
NOW THEREFORE THE FOLLOWING NOTICE OF THE SALE IS GIVEN:
1. Property to be Sold Lot: 31, Block: D, of Lakeside on Preston Phase 1C, Lakeside Country
Estates, an addition to the Plano, Collin County, Texas, according to the Plat thereof
recorded in Volume J, Page 738, of the Deed Records of Collin County, Texas. Together
with Certificate ofCorrection filed 06/ 04/ 1997, recorded in Volume 3925, Page 58, Land
Records ofCollin County,Texas [5220 Creekpoint Drive, Plano, Texas 75093] hereinafter
the" Property"). The conveyance ofthe Property will be as is and further subject to any
validDeed ofTrust,taxliens orotherliensdeemed superiorandsecuredbytheProperty.
2. Date, Time, and Place of Sale. The sale is scheduled to be held at the following date, time, and
place:
Date: August 4, 2026
Time: Between 10:00 a.m. and 1: 00 p.m. local time
Location: The Southwest Entrance ofThe Jack Hatchell Collin County Administration Building
Located at 2300 Bloomdale Road, McKinney, Texas 75071
IftheAssociationelectstopostpone orwithdraworreschedulethenonjudicial foreclosure salefor
another day, the appointed agent under the Lien need not appear at the date, time, and place ofthe
scheduled sale to announce such postponement, withdraw, or rescheduling. Notice ofthe date of
any rescheduled foreclosure sale will be reposted and refilled in accordance withthe posting and
filing requirement ofthe Texas Property Code. Such reposting orrefilling may be afterthe date
originally scheduled for said foreclosure sale.
3. Terms of Sale The sale will be conducted as apublic auction' as is" to the highest bidder for cash.Those desiring to purchase the property will need to demonstrate their ability to pay cash on the
day ofsale for the property being sold.
4. Type of Sale. The sale will be aanonjudicial lien foreclosure sale in accordance with theterms
and authority granted the Association by the Texas Property Code and the Declaration, and the
attached Order obtained in accordance with Tex. R. Civ. P. 736.
5. Obligation Secured. The Declaration secures the payment of the Association homeowner
member assessments, and the Association's fees and costs associated with collecting these
assessments.
6. Default and Request to Act. Default has occurred under the terms ofthe Declaration and the
Association has requested that the undersigned Authorized Agent to conduct the nonjudicial
foreclosure sale. Notice is hereby given that prior to the foreclosure sale the Association may
appoint another person to act as anAppointed Agent to conduct said sale.

OF FORECLOSURE SALE AND FORECLOSURE SALE
The Court, considering the Lakeside on Preston MasterAssociation, Inc. (" Petitioner"),
Application for Expedited Foreclosure filed pursuant to Rule 736 ofthe Texas Rules ofCivil
Procedure ( the " Application") and concerning 55220 Bridgecreek Drive, Plano, Texas 75093
the " Property") owned by Harold G. Hughes and Robin M. Hughes (" Respondents"), finds as
follows:
1. The Property, is subject to an assessment obligation owed to the Petitioner and a
lien sought to be foreclose which is contained in the Corrected First Amended and
Restated Master Declaration ofCovenants, Conditions and Restrictions forLakeside
on Preston, filed ofrecorded as Document No. 2004-0083401 et seq., in the Real
Property Records of Collin County, Texas, as amended and/or supplemented
hereinafter the " Declaration") and which requires the Respondent to pay the
Petitioner certain property owners' association assessments and related charges.

PROPOSED ORDER 12. Respondent owns the property which is the subject ofthe Petitioner' s lien sought to be
foreclosed in the Application with the following legal description and street address as
evidenced by the vesting deed recorded under the Denton County Clerk' s Document
No. 2005-0038251 attached to Petitioner' s Application as Exhibit" A-3":
Lot: 31, Block: D, ofLakeside on Preston Phase 1C, Lakeside
Country Estates, an addition to the Plano, Collin County, Texas,
according to the Plat thereof recorded in Volume J, Page 738, of
the Deed Records ofCollin County, Texas. Together with
Certificate ofCorrection filed 06/04/1997, recorded inVolume
3925, Page 58, Land Records ofCollin County, Texas.
3. As reflected by the material evidence presented in the Application, the Respondents
havebreached their obligation andis delinquent inthepayment ofthe assessments, late
interest, collection fees, and legal fees, and which are secured by the Declaration lien
against the Property and continue to accrue;
4. As reflected in Exhibit " A" and " B" to the Application, Petitioner has given the
Respondents the requisite notice to cure the default in accordance with applicable law
and the Declaration and the unpaid amount to cure the defaulted amount and reinstate
the Respondents as set forth in the Application, was $ 14,683.08 at time offiling ofthe
Application and continues to accrue at this time.
5. Respondents' last known address in the records of the Petitioner is 5220 Creekpoint
Drive, Plano, Texas 75093.
6. Respondents, on information and belief, are not a servicemembers within the meaning
of the Servicemembers Civil Relief Act. See Exhibit " D" of the Petitioner's
Application.
7. Petitioner filed its Application in accordance with the requirements ofRule 736 ofthe
Texas Rules of Civil Procedure.
PROPOSED ORDER 28. Respondents were properly served in accordance with Rule 736 of the Texas Civil
Practice & Remedies Code and has failed to timely file a response within the time
period mandated by Rule 736.
9. Accordingly, the Petitioner has met its burden ofproof as required by Rule 736 ofthe
Texas Civil Practice and Remedies Code and is entitled to an order permitting it to
pursue nonjudicial foreclosure notice and sale in accordance Texas law.
ORDERED that Petitioner, the Lakeside on Preston Master Association, Inc.'s Application for
Expedited Foreclosure Proceeding filed in accordance with Rule 736 of the Texas Rules of Civil
Procedure, against the Property, 5049 Bridge Creek Drive, Plano, Texas 75093 with the following
legal description:
Lot: 31, Block: D, of Lakeside on Preston Phase 1C, Lakeside Country
Estates, an addition to the Plano, Collin County, Texas, according to the
Plat thereof recorded in Volume J, Page 738, ofthe Deed Records of
Collin County, Texas. Together with Certificate ofCorrection filed
06/ 04/ 1997, recorded in Volume 3925, Page 58, Land Records of Collin
County, Texas ( 520 Creekpoint Drive, Plano, Texas 75093);
is in all things. GRANTED. It is further ORDERED thatPetitioner is authorized to proceed with
notice of foreclosure sale and foreclosure of the Property through, and in accordance with,
Petitioner' s lien under the Declaration and pursuant to Section 209.0092 of the Texas Property
Code.
